Operators have obligations to remove the trolley in a timely manner (based on risk). If you are not satisfied with the response of the operator, please contact Council on 6333 6211 during business hours to register a customer request. Council’s Rangers may take regulatory action if the item remains in one place for too long.

About the Public Spaces (Unattended Property) Act 2021

The Public Spaces (Unattended Property) Act 2021 and accompanying regulation are in force from 1 November 2022, helping to protect valuable public spaces across NSW from abandoned and unattended items and animals.

The PSUP Act 2021 repeals the Impounding Act 1993 and provides Councils, other public land managers and police with stronger powers and penalties to remove abandoned and unattended property from footpaths, street, parks and waterways.

Risk-based timeframes have been created to require owners and others responsible for private property left in public, such as shopping trolleys, unregistered and abandoned cars, unattended trailers and stray stock to remove their property from public places. The new laws provide Councils with regulatory options such as on-the-spot fines, higher court penalties, rapid seizure action and enforcement orders.

From 1 November 2022 to 30 April 2023 a grace period applies for certain offences relating to classes of property left unattended, including:

*animals (typically straying livestock)

*shopping trolleys

*personal recreational devices such as kayaks and bicycles

This grace period provides and opportunity for members of the public to become familiar with the new laws and make appropriate arrangements for the ongoing storage of their property. It also enables operators of shopping trolleys additional time to implement and comply with the branding requirements in the Code of Practice for Class 2 Items – Shopping Trolleys and other Sharing Service Items.
