About the Public Spaces (Unattended Property) Act 2021

The Public Spaces (Unattended Property) Act 2021 and accompanying regulation came into force from 1 November 2022, helping to protect valuable public spaces across NSW from abandoned and unattended items and animals (specifically straying livestock). Unattended property items may include shopping trolleys, unregistered and abandoned cars, unattended trailers and personal items (such as watercraft).

Risk-based timeframes have been created to require owners and others responsible for private property left in public. The new laws provide Councils with regulatory options such as on-the-spot fines, higher court penalties, rapid seizure action and enforcement orders.
